By accessing or using Velvet (“the Service”), operated by Zeit Industries (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Velvet is a character roleplay platform that allows users to create characters, build worlds, and engage in collaborative storytelling experiences. The Service includes AI-powered character interactions, user-generated content, and community features.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to create an account and use the Service. You agree to provide accurate and complete information when creating your account and to update your information as needed.

4. User Content

You retain ownership of all content you create on Velvet, including characters, stories, and other creative works. By posting content on the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service. You are solely responsible for the content you create and share on the platform.

5. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Harass, abuse, or threaten other users
• Create content that depicts or promotes the exploitation of minors
• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Use automated means to access or interact with the Service without our express permission
• Interfere with or disrupt the Service or servers connected to the Service
• Upload or transmit viruses, malware, or other malicious code

6. NSFW Content

Velvet allows adult and NSFW (Not Safe For Work) content within certain areas of the platform. All users must be at least 18 years of age. NSFW content must be properly tagged and categorized. Even within NSFW contexts, content depicting minors in sexual situations is strictly prohibited and will result in immediate account termination and reporting to relevant authorities. We reserve the right to remove any content that violates these guidelines.

7. Intellectual Property

The Service, including its original content (excluding user-generated content), features, and functionality, is owned by Zeit Industries and is protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free. AI-generated content may contain inaccuracies or unexpected outputs, and we make no guarantees regarding the quality, accuracy, or appropriateness of AI responses.

9. Limitation of Liability

To the fullest extent permitted by law, Zeit Industries shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through your account settings.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in San Francisco, California.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on the Service and updating the effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
